Types of Spousal Support
The DeLoney Law Group, PLLC provides experienced representation to clients who will be receiving support and those who will be paying support. We can answer your questions regarding the different types of support, which include the following:
- Temporary Spousal Support: Financial assistance available to spouses only during the duration of a divorce proceeding or long enough for one spouse to become financially independent
- Permanent Spousal Support: Financial assistance available long-term to spouses who are unable to support themselves
Alimony and spousal support laws differ from state to state. In Texas, alimony is available to a spouse who exhibits financial need during a divorce. In most cases, a spouse can receive alimony for up to three years. If a spouse is the primary caregiver for a child with special needs, or if the spouse is disabled, alimony may be available for a longer period of time.
The court bases its decision to award alimony on a number of factors. Our lawyers will work to persuade the court to award a favorable amount of alimony. Some of the factors the court considers when awarding alimony include:
- Length of the marriage
- Financial need of a spouse
- Ability of a spouse to pay alimony
- Education and current occupation
- Presence of domestic violence
